Can the Finanzamt insist on a sworn translation?
In justified cases, yes. The Fiscal Code allows a German tax office to request a certified translation or one by a sworn translator.
Your UK tax returns, SA302 calculations and HMRC documents translated into German and signed by a sworn translator, for the Finanzamt and beyond.
A sworn tax return translation into German is what you send when the Finanzamt, a bank or the Ausländerbehörde needs to read your UK tax position in German. VisaDocTranslation translates Self Assessment returns, SA302 calculations, P60s and other HMRC documents into German, signed by a sworn translator (beeidigter or ermächtigter Übersetzer), within 2 working days.
Tax documents usually support a wider financial picture, alongside bank statement translations and payslip and employment letter translations.
Germany
It can ask for them. German is the official language of German tax authorities, and under section 87 of the Fiscal Code (Abgabenordnung) the Finanzamt can request a translation of foreign documents and, in justified cases, a certified or sworn one.
In practice many tax offices manage English documents themselves, and their own guidance says translations should be requested only where necessary. But if your Finanzamt asks, it can set a deadline, and if no translation arrives it can commission one at your expense. Ordering your own is usually quicker and certainly easier to budget for.
Most often SA302 tax calculations and Tax Year Overviews, Self Assessment returns, P60 and P45 forms, and HMRC letters such as a certificate of residence. The office asking will specify the documents and tax years.
Ask which tax years are needed before ordering; three years of full Self Assessment returns can add up to a lot of pages.
Usually because of the year you moved, or income you still receive from the UK. Under the UK–Germany double taxation agreement some income is taxed in only one country, but Germany may still take it into account when setting your tax rate.
That rule, the Progressionsvorbehalt, means income Germany doesn't tax can still affect the rate on the income it does. It's a long word for a short idea, and it's why the Finanzamt may want to see UK figures for the year you arrived. We translate the documents; a Steuerberater (tax adviser) can tell you how they affect your return.
Often. Freelancers and the self-employed may be asked for UK tax returns to show previous income, and German banks commonly ask for foreign income documents in German for a mortgage. Check each office's requirements.
For a freelance or self-employed residence permit, the Ausländerbehörde wants evidence that your work is viable, and past tax returns are a natural way to show it. Lenders ask similar questions with even more interest in the answer. In both cases, the full return usually carries more weight than a summary.
Naturalisation and permanent residence applications can also involve proof that you support yourself, and recent tax documents are one way to show it. Whichever office is asking, check which tax years it wants and whether it needs HMRC's own calculation or the return you filed, as the two are different documents.
